upgrade from level 0 to 1 question

if someone upgrade from level 0(completely free) to 1(paying member) and assuming mailchimp is set up to have a separate mail list for level 0 and level 1...

after they upgrade, they are automatically removed from mail chimp list 0 and moved to mail chimp list 1 ?

Yes, this is the usual behavior, this doesn't happen if there's some kind of problem with your settings.

To have s2Member move them from one MailChimp list to the other, besides adding the list for each level in the MailChimp panel, you'll have to check the settings under Automate Un-Subscribe/Opt-Out. WP Admin -> s2Member -> API / List Servers -> MailChimp and Automate Un-Subscribe/Opt-Out
